TERMS AND CONDITIONS VACATION RENTAL
When making an accommodation reservation, the following General Conditions will enter into force, which will govern the seasonal accommodation rental contract between you and the Property, with the intermediation of Ana Clara Wohlang da Silva.
1. – Payment and contracting conditions –
You can make your reservation by phone or by email. Your reservation will be confirmed upon receipt of the correctly completed reservation form plus the bank receipt that justifies the transfer of the amount indicated for the reservation. When making the first payment, the client/tenant declares at the same time that he has read and understood the general conditions of Ana Clara Wohlang da Silva who accepts them. Ana Clara Wohlang da Silva reserves the right to cancel the reservation, if after 5 days of sending the reservation form the payment has not been made. In cases where a reservation is made when there are less than 5 days left before the start of the reserved stay, payment must be made for the total amount.
2. – Payment methods –
- 50% in advance when making the reservation by bank transfer.
- 30% must be paid 15 days before entering the accommodation by bank transfer to the account indicated.
- The remaining balance (20%) must be paid in cash on the day of arrival.
- Method of payment: bank transfer – Ana Clara Wohlang da Silva reserves the right to cancel the reservation without notice if the full amount of the reservation has not been received on the indicated dates. In this case, the client/tenant may not claim or demand the fulfillment of the reservation or the reimbursement of amounts already paid.
3. – Prices –
Published prices are subject to change without prior notice.
4. – Check-ins & Check-outs –
The arrival time will be between 4:00 p.m. and 9:00 p.m., and the departure time at 10:00 a.m. in the morning. If you cannot occupy the accommodation during the day of arrival or during the key delivery time due to any difficulty during the trip or for personal reasons, as well as if you shorten your stay, Ana Clara Wohlang da Silva will not make any refund.
5. – Cancellation of the contract by the client and refunds –
The client has the right to cancel the reservation subject to the following conditions:
- Refund of 50% of the reservation if the contract is canceled up to 60 days before entering the accommodation once Ana Clara Wohlang da Silva’s management expenses have been deducted.
- There will be no refunds outside of this period.
- In case of refunds, the management fee will be one hundred euros (€100). A cancellation is considered effected at the moment Ana Clara Wohlang da Silva has received the cancellation in writing.
6. – Alternative or cancellation of the contract by Ana Clara Wohlang da Silva –
In cases of force majeure or supervening impossibility of the property for the client’s stay, Ana Clara Wohlang da Silva will offer them the possibility of choosing (when possible) between replacing the accommodation with another of similar characteristics, or canceling the contract by reimbursing the Owner the total amount delivered by the client.
7. – Customer obligations –
The occupation of the accommodation will be limited to the number of people indicated in the contract, counting children and babies also as people for the purposes of occupation. The owner or the key manager may prevent entry to the accommodation in the event of exceeding the number allowed. If the tenant exceeds the property’s capacity, this will incur in an extra charge of €50 per night and possible eviction. IT IS FORBIDDEN TO LIGHT THE FIREPLACES OR WOOD STOVES.
Upon arrival at the accommodation, a deposit of three hundred euros (€300) will be paid in cash, without prejudice to its specific determination. Does not apply to rent. It will be returned by bank transfer after checking the property within a maximum period of 15 days from the date of departure, complying with the following conditions:
- There is no damage to the property or its contents.
- There are no charges for illegal activity, pets or tenant fines.
- All rubbish is left in the trash can.
- All keys/electric gate remotes are deposited on the kitchen table/counter top and the property is left locked.
- All charges corresponding to the rental are paid before departure.
- The sheets and towels have no damage.
- There is no check-in or check-out after hours.
- Remote controls for garages and electrical appliances are inside the house.
- If the tenant must be evicted by the landlord or police authority.
If the tenant caused damage to the home for a value greater than the deposit paid, he would have to pay the difference without delay upon receiving the full amount of the damage caused in writing from Ana Clara Wohlang da Silva.
The tenant/client has the obligation to leave the accommodation in a tidy and presentable state. This includes (indicatively, not limitingly) that the dishes must be clean and placed in their place, the refrigerator without any remains of food and the garbage must have been emptied.
The tenant must respect the neighbors and the Rules of the Community of Owners to which the accommodation belongs. In case of negligence or inappropriate behavior Ana Clara Wohlang da Silva and the owner reserve the right to cancel the rental agreement with immediate effect and without prior notice. In this case, Ana Clara Wohlang da Silva will not have the obligation to return the rental amount paid by the client.
Final cleaning or exit cleaning must be paid by the Client/Tenant and can range between €80 and €150 and will be deducted from the amount of the deposit.
8. – Minimum stay one week
9. – Included charges – The rate includes a set of sheets and towels upon arrival.
10. – Maid service – It is not included in the rental price (in rentals of only one week), but can be obtained with an additional charge. However, we suggest bringing beach towels as towels from the house cannot be taken outside.
11. – False reservations – Any reservation obtained with false data will be subject to charges and the rent for the period cannot be guaranteed.
12. – Exceptions in writing – Any exception must be communicated in writing.
13. – Warning: – Jacuzzi/Hot Tub – Children under 12 are not allowed at any time. When using a hot tub/jacuzzi there are certain associated health risks. Use under the sole responsibility of the Client/Tenant. The cleaners use chemicals for their cleaning. IT IS NOT ALLOWED TO STAND ON THE JACUZZI COVER. The jacuzzi cover is not designed for people to stand on it, if it were to break the tenant would be responsible and charged for the damage.
14. – Water and septic tank – The septic tank may emit odors. DO NOT FLUSH anything other than toilet paper. Do not throw compresses in the WC, it could get clogged and the charge for unblocking could reach €200.
15. -Complaints – There are complaint forms available to customers.
16. – Responsibilities – Ana Clara Wohlang da Silva will not assume any responsibility in the following cases:
- Negligence or omission of services attributable to third parties.
- Failures or incorrect operation of swimming pools, children’s play areas and sports facilities of any kind, leaving the use of these strictly under the responsibility of the user.
- Thefts in the accommodations.
- Damage to people or things caused by force majeure or unforeseen setbacks for which neither Ana Clara Wohlang da Silva nor her representatives (key managers) can be held responsible. The responsibility of Ana Clara Wohlang da Silva, therefore, is limited to her intermediation function, according to the scope that it has and is effectively carried out by Ana Clara Wohlang da Silva, not personally assuming any of the responsibilities that, according to Law , correspond to the property in the rental of seasonal accommodation.
- Validity and competent jurisdiction – When making the reservation of an accommodation, the general conditions indicated above will enter into force, which will govern the rental contract for seasonal accommodation between you and the Property. Ana Clara Wohlang da Silva acts as an intermediary between the tenant and the owner of the accommodation and is responsible for the correct execution of the mediation, which is carried out according to the laws in force. These general conditions and the contract between you and the Property will be governed, interpreted and executed according to Spanish law, submitting to the courts of Almuñécar (Granada) and expressly waiving any other jurisdiction.
